These Terms of Service govern your use of ProAdsFuel.com and all related services operated by Dayyan LLC. By creating an account or submitting any form on this site, you agree to these terms in full.
1. Acceptance of Terms
By accessing ProAdsFuel.com, joining the waitlist, submitting a partner application, applying to the Fuel Collective, or subscribing to any paid plan, you confirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.
These terms constitute a legally binding agreement between you (or the company you represent) and Dayyan LLC, an Illinois limited liability company.
3. Accounts and Eligibility
- You must be at least 18 years old to create an account
- You must provide accurate information when creating an account or submitting applications
- You are responsible for maintaining the security of your login credentials
- One account per business entity — sharing accounts between unrelated businesses is prohibited
- We reserve the right to verify any information you provide and reject or suspend accounts that contain false information
4. Subscriptions and Billing
Plans
- Starter — Free. Limited to 3 platforms, 50 AI scripts per month, basic tools
- Growth — $299/month. Full platform access, Burst Guarantee, all 8 core tools
- Enterprise — Custom pricing. White-label, API access, custom terms
- Collective — $499/month + minimum $3,000 monthly ad spend commitment
Billing
- All paid plans are billed monthly in advance via Stripe
- Subscriptions renew automatically unless cancelled before the renewal date
- Founder pricing ($299/month Growth) is locked for life for members who subscribed during the founding period
- We reserve the right to change pricing for new subscribers with 30 days notice
- No refunds are issued for partial billing periods
Cancellation
You may cancel your subscription at any time. Access continues until the end of the paid billing period. Email hello@proadsfuel.com to cancel.
5. The Burst Guarantee™
The Burst Guarantee is Fuel's performance commitment: if we do not measurably improve your ROAS above your baseline within 90 days of full platform onboarding, you pay nothing for that period.
Eligibility Requirements
- Available to Growth and Collective subscribers only
- Requires full ad platform API connection (minimum 2 platforms) within 14 days of subscription start
- Minimum monthly ad spend of $2,000 must be maintained throughout the guarantee period
- Baseline ROAS is established from the 30 days prior to subscription start, verified via platform API
- Improvement is measured against the same campaigns, audiences, and creative types
Exclusions
- Accounts where the subscriber makes unauthorized changes to campaigns outside of Fuel recommendations
- Accounts where ad spend drops below the $2,000 minimum
- Performance changes due to platform-wide policy changes (iOS tracking, algorithm updates)
- First 30-day onboarding period during which baseline is being established
Claiming the Guarantee
To claim a refund under the Burst Guarantee, submit a request to hello@proadsfuel.com within 7 days of the end of the 90-day period. We will review API data and issue a credit or refund within 14 business days if the claim is valid.
6. Fuel Collective Terms
- Collective membership requires a minimum $3,000 monthly ad spend commitment and a $499/month membership fee
- Each member is assigned an exclusive territory — a combination of product category, geographic market, and demographic. No two members share a territory
- Territory exclusivity is contractual and guaranteed for the duration of active membership
- Members must maintain active ad campaigns connected to the platform to remain eligible for budget pooling benefits
- Revenue generated through the Collective pool is tracked via platform API and distributed according to contribution ratios
- Dayyan LLC charges a 15% management fee on ad spend managed through the collective pool
- Collective membership minimum commitment is 3 months
7. Data and API Connections
- By connecting your ad platform accounts, you grant Dayyan LLC read-only API access to campaign performance data
- We do not write to, modify, or delete any campaigns or ad assets through this access
- You may revoke API access at any time through your ad platform settings
- Performance data used in leaderboard rankings is anonymized by default. Company names are only shown on the public leaderboard with your explicit written consent
- Campaign-level data is never shared with other subscribers
8. Prohibited Uses
You may not use the platform to:
- Submit false ROAS data or misrepresent campaign performance
- Scrape, copy, or redistribute leaderboard data or the Fuel Index
- Attempt to reverse-engineer or access other users' campaign data
- Use the platform to run campaigns for illegal products or services
- Create multiple accounts to circumvent plan limits
- Impersonate another brand or agency
- Attempt to manipulate your Fuel Score through artificial means
Violation of these terms may result in immediate account suspension without refund.
9. Intellectual Property
All content on ProAdsFuel.com — including the Fuel Index reports, Fuel Score methodology, tool interfaces, branding, and written content — is owned by Dayyan LLC and protected by copyright and trademark law.
The Burst Guarantee™ is a trademark of Dayyan LLC.
You may not reproduce, distribute, or create derivative works from any platform content without written permission.
10. Limitation of Liability
To the maximum extent permitted by law, Dayyan LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, revenue, data, or business opportunities.
Our total liability for any claim related to the platform shall not exceed the amount you paid us in the 3 months prior to the claim.
Platform data is provided for informational purposes. Past ROAS performance of other campaigns does not guarantee future results for your campaigns.
11. Termination
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or cause harm to other platform users. In cases of serious violation, termination is immediate with no refund. For minor violations, we will provide 7 days notice to remedy the issue before termination.
12. Governing Law
These terms are governed by the laws of the State of Illinois, United States. Any disputes shall be resolved in the courts of Cook County, Illinois. You waive any objection to jurisdiction or venue in these courts.
For disputes under $10,000, we agree to binding arbitration administered by the American Arbitration Association in lieu of court proceedings.
